Liberalism’s concern with human freedom seems related to contractual freedom and thus contract law. There are, however, many strands of liberal thought and which of them best justifies contract is a difficult question. In The Choice Theory of Contracts, Hanoch Dagan and Michael Heller offer a vision of contract based on autonomy. Drawing on the work of Joseph Raz, they argue that extending autonomy should be the law’s primary concern, which requires that we extend the range of contractual choices (...) available. While there is much to admire in their work, I argue that autonomy as conceived by Dagan and Heller cannot justify contract law. First, there are reasons to doubt the coherence of autonomy as an ideal. Second, given the pluralism of liberal societies, which, for example, often include substantial numbers of religious believers who reject core assumptions of autonomy theory, it is doubtful that such a theory can legitimate contract law. A more modest version of liberalism concerned primarily with protection against cruelty and providing a modus vivendi in pluralistic societies is more tenable. Such a vision of liberalism yields a more modest vision of contract law. Rather than making it into another means of realizing the dream of a more autonomous self, it is enough that contract law facilitates commerce and the marketplace. Markets in turn can serve an important — albeit limited — role in sustaining the peaceful cooperation and coexistence toward which a more realistic liberalism should aim. (shrink)

In “The Choice Theory of Contracts,” we explain contractual freedom and celebrate the plurality of contract types. Here, we reply to critics by refining choice theory and showing how it fits and shapes what we term the “Contract Canon”. I. Freedom. (1) Charles Fried challenges our account of Kantian autonomy, but his views, we show, largely converge with choice theory. (2) Nathan Oman argues for a commerce-enhancing account of autonomy. We counter that he arbitrarily slights noncommercial spheres central to (...) human interaction. (3) Yitzhak Benbaji suggests that choice theory’s commitment to autonomy is overly perfectionist. Happily, in response to Benbaji, we can cite with approval Charles Fried’s point that contract types are “enabling our liberties.” II. Choice. (4) Aditi Bagchi criticizes our inattention to impediments to choice. We show how choice theory’s commitments to both multiplicity and relational justice ameliorate these impediments. (5) Gregory Klass explores parol evidence to highlight the mechanisms of choice. We substantially concur with his position, and show how such mechanisms can ensure voluntariness, an essential element of choice. (6) Oren Bar-Gill and Clayton Gillette question the institutional capacity of existing legal actors to implement choice theory. Working from the example of cohabitation, we offer a somewhat more optimistic view. III. Contracts. (7) Peter Benson contends our focus on the rational slights the reasonable. Although we did not use this Rawlsian vocabulary, choice theory complies with its strictures — more so than transfer theory. (8) Daniel Markovits and Alan Schwartz claim provocatively that contract theory must: capitulate before pluralism (as they endorse); leverage it; or fall victim to a so-called “embracing” approach (their charge against us). We reject the charge that choice theory is foundationally value-pluralist. Instead, we cabin pluralism and put it to work. (9) The Contract Canon starts on the next big step for choice theory by explaining existing doctrine (rebutting Benson on lack of fit) and helping adjudicate contract practice (countering Markovits and Schwartz on the vices of our pluralism). Each Article in this Issue advances the field; each prompts us to refine choice theory — all steps, we hope, toward a more just and justified law of contract. (shrink)

Lane et al.'s proposal that psychotherapeutic change comes about through memory reconsolidation is compelling; however, the model would be strengthened by the inclusion of predictions regarding additional factors that might influence treatment response, predictions for improving outcomes for non-responsive patients, and a discussion of how the proposed model might explain individual differences in vulnerability for mental health problems.

Psychological studies of touch and blindness have been fraught with controversy. Within this field there remains an important theoretical divide. Many researchers have taken a cognitive approach to the study of touch and blindness, relating these to higher order processes, such as memory and concept formation. Others adopt a theoretical perspective, arguing that it not necessary to consider the 'internal representation' of the stimuli, when investigating touch - thus people make use of information from the physical biomechanical properties of their (...) limbs as they assess the physical properties of objects. In addition, psychologists differ in the relative importance they place on the modality of sensory stimulation for subsequent perceptual experiences. Some psychologists argue that touch can do many of the things that are accomplished by vision, and claim that the mode of sensory stimulation is not critically important for perception, arguing that much information can be obtained through non-visual modalities. Others suggest that there are important consequences of a lack of visual experience, arguing for the importance of multiple forms of sensory input for conceptual development. New to the Debates in Psychology series, Touch, Representation, and Blindness brings together the leading investigators in these areas, each presenting the evidence for their side of the debate. An introductory chapter sets the theoretical and historical stage for the debate, and a concluding chapter draws together the different views and ideas set forth by the contributors, summarizing and resolving the discussion. I demonstrate that a "speech act" theory of meaning for imperatives is—contra a dominant position in philosophy and linguistics—theoretically desirable. A speech act-theoretic account of the meaning of an imperative !φ is characterized, broadly, by the following claims. -/- LINGUISTIC MEANING AS USE !φ’s meaning is a matter of the speech act an utterance of it conventionally functions to express—what a speaker conventionally uses it to do (its conventional discourse function, CDF). -/- IMPERATIVE USE AS PRACTICAL !φ's CDF is to (...) express a practical (non-representational) state of mind—one concerning an agent's preferences and plans, rather than her beliefs. -/- Opposed to speech act accounts is a preponderance of views which deny that a sentence's linguistic meaning is a matter of what speech act it is used to perform, or its CDF. On such accounts, meaning is, instead, a matter of "static" properties of the sentence—e.g., how it depicts the world as being (or, more neutrally, the properties of a model-theoretic object with which the semantic value of the sentence co-varies). On one version of a static account, an imperative 'shut the window!' might, for instance, depict the world as being such that the window must be shut. -/- Static accounts are traditionally motivated against speech act-theoretic accounts by appeal to supposedly irremediable explanatory deficiencies in the latter. Whatever a static account loses in saying (prima facie counterintuitively) that an imperative conventionally represents, or expresses a picture of the world, is said to be offset by its ability to explain a variety of phenomena for which speech act-theoretic accounts are said to lack good explanations (even, in many cases, the bare ability to offer something that might meet basic criteria on what a good explanation should be like). -/- I aim to turn the tables on static accounts. I do this by showing that speech act accounts are capable of giving explanations of phenomena which fans of static accounts have alleged them unable to give. Indeed, for a variety of absolutely fundamental phenomena having to do with the conventional meaning of imperatives (and other types of practical language), speech act accounts provide natural and theoretically satisfying explanations, where a representational account provides none. This study examines the mediating role of rumination, state anger, and blame attribution, and the moderating role of trait forgiveness in the relationship between workplace harassment intensity and revenge among employed students at a medium-sized Midwestern U.S. university and full-time employees from various industries in Shanghai, China. We tested the proposed model using techniques described by Hayes. Results within both samples suggested that workplace harassment intensity is positively associated with both major and minor revenge. Results of multiple mediation tests showed (...) that state anger and blame attribution mediated the relationships between workplace harassment intensity and both types of revenge behavior. Furthermore, trait forgiveness moderated the relationship between blame attribution and major revenge. (shrink)

In this essay, I reply to the above four critics of In Defense of Kant’s Religion (IDKR). In reply to George di Giovanni, I highlight the interpretive differencesthat divide the authors of IDKR and di Giovanni, and argue that di Giovanni’s atheist reading of Kant does not follow, even granting his premises. In reply to Pamela Sue Anderson, I show that if her reading of Kant is accurate, Kant’s own talk of God becomes empty and contemptible by his own lights, (...) and I then show how her empirical bias prompts a significant misreading of IDKR. In reply to Stephen Palmquist, I expose four fallacious maneuvers in his paper, which comprise the bulk of his essay. And in reply to Michalson, I address a series of minor concerns raised in his essay, and then set the record straight on the motives behind IDKR in general and my own take on Kant’s compatibility (or lack thereof) with Christianity in specific. Whether intentional suppression of an unpleasant or unwanted memory reduces the ability to recall that memory subsequently is a contested issue in contemporary memory research. Building on findings that similar processes are recruited when individuals remember the past and imagine the future, we measured the effects of thought suppression on memory for imagined future scenarios. Thought suppression reduced the ability to recall emotionally negative scenarios, but not those that were emotionally positive. This finding suggests that intentionally avoiding thoughts about emotionally (...) negative episodes may inhibit representations of those memories, progressively reducing their availability to recall. Maritain, in the most interesting passages of Art and Scholasticism, concerned himself with this astonishing "growth of self-consciousness" in the modern artist. And what chiefly occupied him was the thought that, in submitting to the idea of making art out of the idea of art, the artist might (...) become so fascinated with technique and so estranged from the existential world of nature and the universe of man that he should forget that, unlike God, he cannot create ex nihilo. He wanted, then, to confront him with the futility of claiming any kind of aseity for his art, for pure art, he said, "involves nothing, the subject being completely whittled away. I call that a sin of idealism in relation to the matter of art: pushed to the extreme, a perfect building, with nothing to build." The idea of making poetry out of the idea of poetry or painting out of the idea of painting can, in other words, never yield anything but sterility, since the kind of "metaphysical vastness" that characterizes greatness in the arts has always been a result of vital transactions between the creative Self and the universes of Being. And for the poet or the painter to seek to allay the kind of "eucharistic passion" that arises at the very center of the artistic process is for him to run the risk of suicide, since it is for him to isolate his art from everything that is not "its own peculiar rules of operation." In this essay, I argue that both human souls and angels are hylomorphic, a position I dub “pneumatic hylomorphism” (PH). Following a sketch of the history of PH, I offer both an analytic and a confessional defense of PH. The former argues that PH is the most cogent anthropology/angelology, given the Christian understanding of the intermediate state and angels. My confessional defense shows that PH plays a crucial role in pro-Nicene theology. I close with an assessment of contemporary anthropological alternatives, (...) and conclude these do not advance the discussion beyond the patristic and medieval alternatives; thus PH remains the most cogent and confessional sound option. In recent decades there has arisen what Keith Yandell labels the “new wave” of Kant interpretation. These “new wavers” argue that Kant has a more robust view of God and religion than traditionally granted. This article is part of an exchange with Chris Firestone, originally presented at the AAR’s annual meeting, on the question “Can the New Wave Baptize Kant’s Deism?” In what follows, I argue no, contending that the theologically robust Kant of the new wave still builds on a (...) foundation that is fundamentally incompatible with historical Christianity. Critical cellular functions, including stem cell maintenance, fate determination, and cellular behavior, are governed by canonical Wnt signaling, an evolutionarily conserved pathway whose intracellular signal is transduced by β‐catentin. Upholding cooperative norms via punishment is of central importance in organizations. But what effect does punishing have on the reputation of the punisher? Although previous research shows third parties can garner reputational benefits for punishing transgressors who violate social norms, we proposed that such reputational benefits can vary based on the perceived motive for the punishment. In Studies 1 and 2, we found that individuals who endorsed a consequentialist (versus deontological) motive for punishing were seen as more trustworthy. In Study (...) 3, the results showed that when pitted against one another, a person who endorsed a consequentialist (versus deontological) motive for punishing was chosen more often as a partner in a Trust Game. In Study 4, we found that a manager who expressed a consequentialist reason for punishing an employee was seen as having less psychopathic tendencies, and this related to the manager being perceived as more trustworthy and a superior cooperation partner. Using a recall methodology, Study 5 results showed that employees who perceived their managers as having more consequentialist (versus deontological) motives for punishing also perceived their managers as being less psychopathic and more trustworthy. Objective To assess parental permission for a neonate's research participation using the MacArthur competence assessment tool for clinical research (MacCAT-CR), specifically testing the components of understanding, appreciation, reasoning and choice. Study Design Quantitative interviews using study-specific MacCAT-CR tools. Hypothesis Parents of critically ill newborns would produce comparable MacCAT-CR scores to healthy adult controls despite the emotional stress of an infant with critical heart disease or the urgency of surgery. Parents of infants diagnosed prenatally would have higher MacCAT-CR scores than parents (...) of infants diagnosed postnatally. There would be no difference in MacCAT-CR scores between parents with respect to gender or whether they did or did not permit research participation. Participants Parents of neonates undergoing cardiac surgery who had made decisions about research participation before their neonate's surgery. Methods The MacCAT-CR. Results 35 parents (18 mothers; 17 fathers) of 24 neonates completed 55 interviews for one or more of three studies. Total scores: magnetic resonance imaging (mean 36.6, SD 7.71), genetics (mean 38.8, SD 3.44), heart rate variability (mean 37.7, SD 3.30). Parents generally scored higher than published subject populations and were comparable to published control populations with some exceptions. Conclusions The MacCAT-CR can be used to assess parental permission for neonatal research participation. Despite the stress of a critically ill neonate requiring surgery, parents were able to understand study-specific information and make informed decisions to permit their neonate's participation. Dominical categories are categories in which the notions of partial morphisms and their domains become explicit, with the latter being endomorphisms rather than subobjects of their sources. These categories form the basis for a novel abstract formulation of recursion theory, to which the present paper is devoted. The abstractness has of course its usual concomitant advantage of generality: it is interesting to see that many of the fundamental results of recursion theory remain valid in contexts far removed from their classic (...) manifestations. A principal reason for introducing this new formulation is to achieve an algebraization of the generalized incompleteness theorem, by providing a category-theoretic development of the concepts and tools of elementary recursion theory that are inherent in demonstrating the theorem.Dominical recursion theory avoids the commitment to sets and partial functions which is characteristic of other formulations, and thus allows for an intrinsic recursion theory within such structures as polyadic algebras. This article seeks to present a detailed textual analysis of Protagoras’ Great Speech in Plato's Protagoras. I will argue that the concept of ἀρετή as it appears in the Great Speech is whittled down to a vague notion of civic duty. In this respect, Protagoras is bringing himself in line with the democracy, but in doing so the ἀρετή he claims to teach loses much of its initial appeal, particularly in the eyes of his aristocratic clientele. Nevertheless, if thecontentof Protagoras’ (...) Great Speech overlooks the abilities required to rise to political prominence, theformmost assuredly does not. As one would expect from Plato's Protagoras, his speech is replete with just that oratorical prowess his students might expect to acquire from him. This, in turn, has a number of interesting and important implications in the broader context of theProtagoras, in particular regarding the contrast or conflict between long speeches and short-answer dialectic. Moreover, although it has long been noticed that Protagoras neglects rhetoric and personal pre-eminence in his account, as far as I know there has not been any serious attempt to analyse the stylistic aspects of this masterful speech. Increasingly, policymakers are turning to investments in technology and digital infrastructure to address these problems. Yet the move towards so-called smart cities is not simply responsive, and policymakers increasingly advocate for smart city initiatives as a necessary step towards objective, efficient, and rational governance. This understanding of technological interventions as inherently progressive, however, causes many to overlook the (...) erasures, biases, and limitations that emerge from trying to leave the past behind. As the problems associated with this enthusiasm become more apparent, the smart city movement must therefore recalibrate its relationship to not just technology but time itself. Building on deconstructive temporalities emerging out of quantum physics, I argue that cities must begin drawing from alternative temporalities more open to the intersections between past, present, and future. As such, I suggest that the time has come to replace the ideal of the smart city with that of the spectral city – an incomplete city haunted by the ghosts of the past. (shrink)

God is a problematic idea in Kant's terms, but many scholars continue to be interested in Kantian theories of religion and the issues that they raise. In these new essays, scholars both within and outside Kant studies analyse Kant's writings and his claims about natural, philosophical, and revealed theology. Topics debated include arguments for the existence of God, natural theology, redemption, divine action, miracles, revelation, and life after death. The volume includes careful examination of key Kantian texts alongside discussion of (...) their themes from both constructive and analytic perspectives. These contributions broaden the scope of the scholarship on Kant, exploring the value of doing theology in consonance or conversation with Kant. The current study investigated the relationship of the Dark Triad with peer reporting, which occurs when an employee informs management that another coworker has engaged in counterproductive work behavior (CWB). We hypothesized that low organizational commitment would strengthen the negative relationships between each Dark Triad trait and peer reporting. Data from 281 employees suggested that low organizational commitment indeed strengthened the negative relationships between (a) narcissism and the base rate of peer reporting CWBs and (b) psychopathy and the base rate (...) of peer reporting CWBs. Our findings thus extended Dark Triad research to the topic of peer reporting. (shrink)
